Name/Image/Likeness (NIL) Guidance for University of Central Arkansas Boosters & Fans (7/1/21)

Effective July 1, 2021 the NCAA has permitted student athletes to monetize their NIL through promoting or endorsing products, starting their own business, or working camps and clinics.

Permissible student-athlete NIL activities must involve the student-athlete completing an NIL-related activity (e.g., endorsing a commercial product or service; posting/tweeting about a product or service; making an in-store appearance; signing autographs) at commensurate rate in order to be compensated by a third-party for the NIL activity.

University of Central Arkansas boosters may compensate a Central Arkansas student-athlete in exchange for the student-athlete promoting or endorsing the booster's business or fulfillment
of other permissible NIL activities.

Permissible NIL transactions are between a
student-athlete and a third-party. The University of Central Arkansas is not a party to a student-athlete's NIL transactions.

University of Central Arkansas coaches, staff, administrators, faculty or other University personnel may not refer
student-athletes to third-parties (including boosters) for NIL opportunities nor coordinate, organize, promote, or otherwise be involved in a student-athlete's NIL activities except for providing educational programming on NIL and other support services and resources, as permitted.

Student-athletes will be obligated, per procedures specified, to disclose all of their NIL activities to the University of Central Arkansas.

Recruits (aka prospects) will be obligated to disclose to the University of Central Arkansas all of their past NIL activities at the point the recruit signs a national letter of intent/athletics scholarship or makes a financial deposit to the University of Central Arkansas.

Recruits may not receive compensation from anyone in exchange for committing to, or signing a scholarship with, the University of Central Arkansas. This activity is considered an impermissible recruiting inducement, is a violation of NCAA rules, and could cause competition ineligibility for the recruit.

Student-athletes may not receive any compensation (e.g., cash, gifts, etc.) for athletic performance, ability, or simply because they are University of Central Arkansas student-athletes. Such compensation is considered "pay for play" which remains prohibited by NCAA rules. Pay for play could cause a student-athlete to be ineligible for competition.

Student-athletes may use professional service providers (e.g., attorney; tax consultant; financial advisor) that are owned by University of Central Arkansas boosters provided the student-athlete uses such services consistent with the way the services are provided to other clients. Existing NCAA legislation related to offers and inducements and extra benefits would continue to apply.

NCAA rules restricting preferential treatment, extra benefits, recruiting inducements and contact restrictions still apply to boosters.

NCAA, ASUN, University of Central Arkansas, state and/or federal NIL policies and procedures are subject to change.
